### Terms of Service for OpenWeb.co.za Beta Testing Program#### 1. IntroductionWelcome to the beta testing program ("Beta Program") for OpenWeb.co.za ("Company"). By participating in the Beta Program, you agree to abide by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not participate in the Beta Program.#### 2. Description of ServiceThe Beta Program involves testing early versions of the Seedbox service ("Service") provided by the Company. This Service allows participants to host and manage digital files via a remote server environment. Please note that the Service, being in beta, is subject to changes, frequent updates, and potentially service interruptions.#### 3. Eligibility and ParticipationTo participate in the Beta Program, you must:- Be at least 18 years old or have legal parental or guardian consent.- Agree to provide timely feedback regarding your use of the Service.- Use the Service in accordance with these Terms and any applicable laws.#### 4. User ResponsibilitiesYou are solely responsible for the data you load onto your Seedbox. Only legally obtained torrents and files are allowed to be uploaded and used with the Service. You take full and sole responsibility for managing your Seedbox and ensuring that all content stored and shared through your Seedbox complies with applicable laws and these Terms.#### 5. Prohibited ActivitiesYou are prohibited from engaging in the following activities:- Uploading or sharing content that infringes on intellectual property rights or violates any law.- Using the Service to transmit malware or any other malicious software.- Attempting to gain unauthorized access to other accounts or disrupting the integrity of the Service.#### 6. No LiabilityThe Company will not be held responsible for any data you load onto the server. The Company does not have access to your files and does not monitor the content stored within your Seedbox. Consequently, you agree that the Company is not liable for any loss, damage, or harm resulting from your use of the Service.#### 7. Termination and AccessThe Company reserves the right to terminate your access to the Service immediately and without notice if you are found to be in violation of these Terms or engaging in illegal activity. Upon termination, your Seedbox and all associated data may be deleted.#### 8. Disclaimer of WarrantiesThe Beta Program is provided on an "as is" and "as available" basis. The Company expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.#### 9. IndemnificationYou agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your Seedbox (including negligent or wrongful conduct).#### 10. Changes to TermsThe Company reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Terms at any time. It is your responsibility to check these Terms periodically for changes. Your continued use of the Service following the posting of changes will mean that you accept and agree to the changes.#### 11. Governing LawThese Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is based, without giving effect to any principles of conflicts of law.#### 12.
