Terms of Service pertaining to LTE as extracted from OpenWeb's General Terms of Service: 5.1. All hardware supplied by Openweb will include a 12-month manufacturer?s warranty. Faulty hardware will be swapped out for a once off courier cost of R199 per incident. 5.2. All OpenWeb LTE-A packages are ?best-effort? services and Upload and Download speeds cannot be guaranteed. (Speed is reliant on many factors such as coverage/distance from base station, prevailing weather conditions and base station congestion) etc See clause 4.5. 5.3. The early cancellation of any fixed term LTE-A contract is allowed (as defined by Section 14 of the CPA 2008) but the user will be responsible for an early cancellation penalty. (The reason this penalty exists is because Openweb is obligated to conclude 24 month contract/s on uncapped LTE-A [Telkom] accounts). 5.3.1 Early cancellation penalty fee ? A user will be charged 3 x normal monthly subscription and be held liable for the full remainder of the hardware cost of the contract term. 5.4. Capped OpenWeb LTE-A packages will be available on month-to-month basis, Uncapped LTE-A solutions are only available on a 24-month contract basis and are subject to a FUP - Up to 12Mbps until 200GB, then up to 6Mbps until 350GB, then up to 3Mbps for the rest of the month - resets on 1st day of each month. 5.5. Bandwidth caps included in monthly subscription will be replenished on the 1st of every month. 5.5.1. Top-ups can be purchased at any time, payment is tendered via Credit Card. 5.5.2. Users will be billed for the total volume of data both sent (TX) and received (RX). 5.6. Any unused monthly data shall be forfeited at the end of every calendar month (Data is not carried over to the next calendar month); 5.7. Should a user sign a conrtact during a month other than on the 1st, the data and the billing will be done pro-rata accordingly for the remaining days of the particular month and the User will be billed along with the first full calendar month billing; 5.8. Add on bundles will be valid for 30 (thirty) days. (As an example, should a user purchase an Add on bundle on the 25th of July, the Add on bundle will expire on the 24th of August at 23:59). 5.9. Any unused Add on bundle/Value added service shall be forfeited at 23:59 on the expiry date. 5.10. Upon reaching the data limit/cap for the month, the User will be required to ?top up? in order to continue normal service. 5.11. The Users location must be in the service coverage map for the selected LTE-A/Fixed LTE network. MTN LTE-A solutions are locked to the location that is specified when the service is ordered. 5.12. Services which are provisioned outside of the coverage area at the users insistence are provisioned entirely at the user?s risk. 5.13. Failure to adhere to agreed delivery arrangements with the courier company may result in a shipping penalty of R199.00 been charged and further cancellation of the agreement. 5.14. Failure of the delivery company to reach the user in five attempts to make delivery arrangements will result in cancellation of the agreement and a service fee of R999 be billed to the User. 5.15.2 In the event that equipment has to be swapped out the once off installation and / or decommission fee applicable (R400) to the required bandwidth may apply. 5.17. It is the user's responsibility to fully insure the hardware for theft and damage. The user is fully liable for the replacement cost of the router if stolen or damaged. 5.18. The hardware remains the property of OpenWeb at all times. The user is deemed to be renting the hardware from OpenWeb. Upon the cancellation of the service, after the initial 24-month period has lapsed, the hardware must be returned to OpenWeb or may be purchased for a once off fee of R149.00. 5.19. By agreeing to our terms, you confirm that you have a phone or wearable that allows the use of eSIMs. This product does not offer traditional SIM cards. OpenWeb will not refund you if your device does not offer eSIM access. It is your responsibility to ensure that the device you will be using has the latter functionality. 5.20. Our Anonymous VPN Lite and Anonymous VPN Pro accounts are offered by a third party company. You agree to comply with all applicable laws, rules, and regulations, including without limitation all local rules where you reside or your organization is located regarding User Content, User Websites, online activities, email and your use of the Services. More specifically, but without limitation, you agree to comply with all applicable laws regarding the transmission of technical data exported to or from the United Kingdom or the country in which you reside. The Services are controlled and operated by us from our offices within the United Kingdom (although we may share data with third parties around the world to assist us in providing the Services as further described in our Privacy Policy) and we make no representation that the Services are appropriate or available for use in other locations. Those who access the Services from other locations do so at their own initiative and risk, and are fully responsible for compliance with all applicable laws in those locations. We do not offer the Services where prohibited by law. For the purposes of European Directive 95/46/EC, the General Data Protection Regulation 2016/679) (“GDPR”) and any applicable national implementing laws in your jurisdiction, and with respect to your subscribers’ or customers’ personal data, you acknowledge and agree that you are the Controller (as that term is defined in the GDPR), and we are a Processor (as that term is defined in the GDPR) insofar as you may store personal data through your use of our Services only as permitted and subject to the terms of this Terms. You also acknowledge and agree that you are responsible for complying with all obligations of a data controller under applicable law (including the GDPR). To the extent the GDPR applies to you, you represent and warrant that in using our Services, you will clearly describe in writing how you plan to use any personal data collected and you will ensure you have a legitimate legal basis to transfer such personal data to us and that you have the necessary permission to allow us to receive and process (e.g., store) such personal data on your behalf. The additional data processing terms set forth in Privacy Terms shall apply where you are a Controller subject to the GDPR. Additional User Responsibilities You will be solely responsible for all activities conducted on or through a Subscriber Website, including any transactions or interactions with end users of a Subscriber Website. You will be solely responsible for providing such end users with any required disclosure or explanation of the various features of the Subscriber Website and any goods or services offered thereon, as well as any terms of use and privacy policy for the Subscriber Website. You will cooperate fully with Company in connection with Company's provision of the Services. It is solely your responsibility to provide any equipment or software that may be necessary for you to use the Services. Delays in your performance of your obligations under this Terms will extend the time for Company's performance of its obligations that depend on your performance. You will be solely responsible for ensuring that all Subscriber Content and Subscriber Websites are compatible with the hardware and software used by Company to provide the Services, which hardware and software may be changed by Company from time to time in its sole discretion. You will use your best efforts to ensure that the Subscriber Content is and will at all times remain free of all computer viruses, worms, Trojan horses and other malicious code. You will not use the Services in any manner, as determined by Company in its sole discretion, that: Engages in or promotes illegal activity; Engages in or promotes behavior that is defamatory, harassing, abusive or otherwise objectionable; Infringes the intellectual property rights or other proprietary rights of any third party; Violates the privacy rights or publicity rights of any third party; interferes with the operation of the Services; or Violates the terms and conditions of this Terms or any of the policies or Terms incorporated by reference herein. 5.22 Roaming is subject to availability.
